South Africa’s Consumer Watchdog Tackles Foreign E-Commerce Giants

South Africa’s Consumer Goods and Service Ombud (CGSO), a crucial independent body for resolving consumer disputes, is facing a significant challenge in the rapidly growing e-commerce market. The CGSO is increasingly swamped with complaints from South African consumers regarding their experiences with foreign e-commerce platforms, specifically Shein and Temu. However, their ability to effectively address these issues is severely limited by the lack of legal jurisdiction over these platforms, which don’t have a direct physical presence in South Africa.

The Jurisdiction Gap: Enforcement Challenges

The core issue lies in the CGSO’s inability to enforce consumer protection laws against Shein and Temu due to their operational structures. Despite the platforms’ popularity, accounting for a substantial 37.1% of the local clothing market, their lack of a physical South African presence, makes it difficult for the CGSO to take decisive action against them. While Temu launched local warehouse support in July 2023, allowing third-party providers to manage local inventory and reduce import fees, this setup doesn’t grant the CGSO jurisdiction as the platform still lacks an official physical presence. This legal loophole hinders the CGSO’s efforts to protect South African consumers from potential unfair practices.

The situation highlights a growing problem in the age of global e-commerce, particularly in Africa, where foreign platforms are quickly gaining market share. The CGSO’s struggle underscores the need for either legal revisions, or other measures that will allow South Africa’s consumer rights body to effectively protect South African consumers who are increasingly using international e-commerce platforms.
