NCC Clarifies SIM Card Ownership for Minors in Nigeria

Recent reports suggesting the Nigerian Communications Commission (NCC) has outright banned SIM card ownership for individuals under 18 have been refuted. The NCC has clarified that while the draft regulations mention 18 as the age of consent for SIM acquisition, this is tied to constitutional provisions. Ultimately, the implication is that those below 18 can still own SIM cards, provided they are acquired in the name of their parents or guardians.

Understanding the Draft Regulations

The confusion stemmed from the draft of the modified Registration of Telephone Subscribers Regulations. Misinterpretations arose following a Public Inquiry held on October 6, 2021, regarding the draft. According to the NCC’s Director of Public Affairs, Dr. Ikechukwu Adinde, the reports circulating are misleading and a misrepresentation of the inquiry’s proceedings. The core principle remains aligned with the Nigerian constitution, which recognizes 18 as the age of consent. Therefore, while direct registration might be restricted, minors can still access mobile connectivity through SIM cards registered by their parents or legal guardians.

In conclusion, the NCC emphasizes that it has not imposed a blanket ban on SIM card ownership for those under 18. The regulatory framework, while considering the legal age of consent, allows for minors to have SIM cards registered in the names of their parents or guardians, ensuring they can still participate in the digital ecosystem under responsible adult supervision.
