Brazilian Indigenous Group Sues TikTok Over Data Center on Ancestral Land

An unprecedented legal challenge has emerged in Brazil as an Indigenous community in the northeastern state of Ceará formally lodged a complaint against TikTok. The Anacé group contends that a planned data center, intended for the giant Chinese social media company, is being developed directly on their ancestral territory. Allegations of Rights Violations and Environmental Concerns

The Anacé community, led by Cacique Roberto Ytaysaba Anacé, asserts long-standing claims over the land earmarked for TikTok’s facility. Their formal complaint to federal authorities argues that their internationally guaranteed right to consultation was completely disregarded during the project’s planning phase. This fundamental right ensures Indigenous populations are consulted on developments affecting their lands and resources. Furthermore, the Anacé leaders have voiced serious apprehensions regarding the data center’s substantial water consumption, concerns they say have been entirely overlooked. Cacique Roberto Ytaysaba Anacé, who candidly admitted to not knowing what a data center was just months prior, is now a determined advocate against the project. He highlighted the sensitive location, stating, “They are putting it right next to the river” on Indigenous territory, a detail underscoring the potential environmental impact. The data center is also set to be powered by Casa dos Ventos, a wind energy company, adding another layer to the complex infrastructure development. This dispute brings to light the broader implications of technological advancement intersecting with Indigenous sovereignty and environmental stewardship.
