NDPC Launches Major Data Privacy Crackdown on Nigerian Firms

The Nigeria Data Protection Commission (NDPC) has initiated a significant enforcement action, investigating 1,369 Nigerian companies for potential data privacy violations. This move, the most extensive since the Nigeria Data Protection Act (NDPA) was enacted in 2023, signals a firm commitment to upholding data protection standards within the country, with implications for the evolving digital landscape in Nigeria and across the African tech sector.

Scope and Requirements for Compliance

The NDPC’s probe targets businesses within vital sectors, including banking, insurance, pension funds, and gaming operators. These sectors handle significant amounts of sensitive personal data. Affected companies are now required to demonstrate compliance with the NDPA within a tight timeframe. Specifically, organizations have only 21 days to furnish the NDPC with their 2024 audit reports, evidence of technical safeguards implemented to protect data, proof of having designated a Data Protection Officer (DPO), and confirmation of their registration as a Data Controller or Processor of Major Importance. Failure to meet these requirements could result in sanctions under the NDPA, underscoring the importance of data privacy governance in the Nigerian business environment.

The NDPC’s actions are a vital step towards establishing a robust data protection framework in Nigeria, aligning the country with global best practices. This crackdown will likely force companies to prioritize data privacy, enhancing consumer trust and encouraging a more responsible approach to data management within the burgeoning African tech ecosystem.
